DSI Limited Product Warranty
Overview
DSI’s goal is to achieve high standards of product reliability and performance and DSI’s Limited Warranty Policy is unparalleled in the physiologic monitoring industry – this reflects DSI’s high standard, coupled with more than 35 years of experience and significant investments in product design, manufacturing and testing.
Telemetry Devices
The in vivo environment presents significant product reliability challenges, particularly for implantable devices used in chronic applications. Included in DSI’s warranty policy is a three-part program covering DSI’s telemetry implants with separate warranty durations for (i) battery life, (ii) implant life, and (iii) maximum warranty period. DSI offers a broad range of implants for various applications for use in species ranging from mouse to large animal models, and warranty periods vary based on the implant model and its intended application. This version of the warranty policy will be in effect as of November 1, 2019, and will supersede any previous warranty policies or references to the warranty in other printed materials.
DSI Exchange Program
DSI Exchange remains available until the implant model has been discontinued. The only restriction is implants must be carefully handled and returned in a condition amenable to exchange. Implants with significant damage beyond normal wear and tear will not be eligible for DSI Exchange.
Non-exchangeable damage includes animal-chewed housings or leaking batteries beyond the Product Warranty Period. If the returned product cannot be exchanged, the customer has the option to purchase a replacement at the current new implant price.
Telemetry Implant Warranty Duration Details
DSI warrants to customers that, for each of the warranty periods set forth below, DSI telemetry implants shall conform to DSI’s applicable published specifications in effect at the time of shipment and shall be free from defects in materials and workmanship. The table below includes the current warranty periods for DSI implants.
For telemetry implants, the “Warranted Battery Life” (WBL) is the cumulative period of battery “on” time for each model, as specified per implant model. DSI warrants the implant will operate within specifications for this period of time. In operation, a particular implant’s battery life may exceed the WBL; however, DSI does not warrant that the implant will operate within specifications when the cumulative on-time has exceeded the WBL.
The “Warranted Implant Life” (WIL) is the cumulative period of time DSI warrants an implant to perform in vivo in accordance with specifications. DSI does not warrant the performance of DSI’s applicable published specifications for devices that have been implanted longer than the WIL. Therefore, if a customer uses telemetry implants for longer periods of time than the WIL, the customer assumes all risk of implant failure, compromised data quality or other adverse effects after the WIL has been exceeded.
The “Warranty Period” (WP) is the continuous period commencing on the date each product is shipped from DSI’s factory to the customer and shall continue for the specified number of months as shown in the table below under the column heading “WP”. It is three months longer than the warranted implant life to allow for shipping time and shelf life prior to implantation and use within the animal.
Device operation and data collection outside of warranty is done at the sole discretion and risk of the customer.
Warranty Coverage Details
During the Warranty Period as defined above, if any of DSI’s products fail to function in accordance with DSI’s then-current published specifications (at the time of shipment) and is either returned to DSI, or DSI is notified in writing prior to the end of the Warranty Period, DSI will repair or replace the product, or those non-conforming parts only, at no charge.
For implants returned outside of warranty, DSI shall charge the standard DSI Exchange fee. The returned product must meet the same criteria outlined in the DSI Exchange Program; otherwise, DSI exchange will not apply and the customer, at its sole discretion, has the option to purchase a replacement at the current new implant price.
As a condition for replacement, DSI may request reasonable evidence showing the periods of implant duration and battery on-time such as in the form of a written log. DSI may, at its discretion, not provide a replacement under warranty absent a presentation of such reasonable evidence by the customer.
As DSI introduces new products, DSI will add these new products to the DSI Limited Warranty Policy. In addition, as production of certain models is discontinued, DSI will have no obligation to continue to offer either DSI Exchange or newly manufactured implants of that specific model.
The customer's sole and exclusive remedy under the foregoing limited warranty is DSI will repair or replace, at DSI's option, any product manufactured by DSI which is defective in material or workmanship during the warranty periods based on the terms set forth below. No warranty will be honored if any such defect is caused in transit from the customer or by customer's negligence, alteration, operation contrary to instructions, misuse, abuse, or if used with parts or accessories not supplied by DSI. Any defective product must be returned to DSI for repair or replacement, transportation prepaid, and must be accompanied by a Product Investigation Form that will be supplied by DSI.
Warranty Coverage for Non-Implantable Telemetry Products
The Warranty Period (WP) for all other DSI products including Hardware, Hardwired solutions, Buxco Respiratory and Inhalation instrumentation is 12 months from the date of shipment for all products. During the WP if any of DSI’s products fail to function in accordance with DSI’s then-current published specifications (at the time of shipment) and is either returned to DSI, or DSI is notified in writing prior to the end of the Warranty Period, DSI will repair or replace the product, or those non-conforming parts only, at no charge.
Product-specific Warranty Coverage
DSI EXPRESSLY WARRANTS ITS PRODUCTS SHALL MEET ITS PUBLISHED SPECIFICATIONS AT THE TIME OF SHIPMENT WITHIN THE APPLICABLE WARRANTY PERIODS. DSI HEREBY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DSI DOES NOT WARRANT THAT ITS PRODUCTS WILL MEET ANY CUSTOMER’S REQUIREMENTS, THAT THE PRODUCTS WILL PRODUCE THE RESULTS EXPECTED BY CUSTOMER, WILL OPERATE IN THE COMBINATIONS (INCLUDING WITH PRODUCTS NOT SUPPLIED BY DSI) WHICH MAY BE SELECTED FOR USE BY THE CUSTOMER, OR THAT THE USE AND OPERATION OF THE PRODUCTS WILL BE UNINTERRUPTED OR ERROR FREE.
DSI DOES NOT MAKE ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO THE ACCURACY OF ANY DATA OR INFORMATION GATHERED USING THE PRODUCTS AND SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES DUE TO ANY ACTION TAKEN OR NOT TAKEN BY CUSTOMER AS A result OF ANY DATA OR INFORMATION GATHERED USING THE PRODUCTS.
